A Zachary father will not be criminally prosecuted for negligence homicide in the death of his 8-month-old daughter, according to the East Baton Rouge District Attorney’s office.

On Wednesday, June 8, Raylee Mercer died after being left in a hot car for too long.  In a statement, DA Hillary Moore says Raylee’s father, Marvin Mercer, “had the misfortune of forgetting that he was supposed to drop his eight month old child at day care on his way to work, a task he was not normally involved in, and, instead, parked as he normally did upon reaching work, leaving his child in the car.”

Moore also said, “all of this is consistent in showing that this was a tragic accident.”
